Can I Notarize a Document for Someone in Another State?

This is one of the most common questions we receive, and the answer is more nuanced than a simple yes or no. The short version: a Florida RON notary can notarize for signers located in other states, but the document's ultimate use and the receiving jurisdiction's rules determine whether that notarization will be accepted.

Florida Law: Where the Notary Must Be

Under Florida law, what matters is where the notary is located, not the signer. A Florida-commissioned RON notary must be physically located in Florida when performing the notarization. The signer can be anywhere with internet access.

This means a Florida notary can legally notarize for a signer in Texas, New York, or Germany. The act is performed under Florida law, using a Florida-approved RON platform, and bears a Florida notary seal.

The Receiving Jurisdiction Question

The more important question is whether the receiving party: a bank, court, government agency, or foreign entity: will accept a Florida RON notarization for their purposes. Most will, with specific conditions:

  • Other U.S. states: under the National Defense Authorization Act's remote notarization provisions and most state-level reciprocity rules, Florida RON notarizations are generally accepted across the U.S.
  • Federal agencies: VA, IRS, Social Security Administration, and most federal bodies accept Florida RON notarizations
  • Foreign countries: this is where variation exists. Some countries require a consular notarization rather than a domestic one. For documents bound for a foreign country, confirm the destination country's requirements first.

When in doubt about a specific receiving institution's requirements, ask them directly before the notarization session. A two-minute call to the accepting bank, court, or agency saves the cost and delay of repeating the process.

Practical Uses

Common scenarios where this matters: a parent in another state needs a Florida child to handle their financial affairs; a business partner in a different state needs to sign a Florida corporate document; a military member stationed abroad needs Florida paperwork completed. In all of these cases, a Florida RON session with Gulf Coast Notary Pros is a legally sound solution.
